I don't know. The league is a monopoly on pro basketball, which is the product Balmer wants. The American Needle v Nfl case throws out the single entity defense the leagues wanted. The players and owners might waive claims under the CBA but not here. Blocking the sale is the restraint on the market. That's good fact.

I agree. He can't claim that he didn't know the league had to approve the deal and reserves the right to reject any deal, all based on what they feel is best for the league. Heck, if Sacramento's group comes up with an equivalent bid and loses, maybe they could file an anti-trust suit. If they weren't given a fair chance to submit a solid bid, because the league the Maloofs and Seattle were conspiring to keep them from having a fair chance to submit a bid.
I love Kenny and Shaq for speaking up for Sacramento. I love Chris Webber especially, becasue he's been behind Sacramento all the way. Sacramento loves you, Chris!

As to the first part this is wrong. He doesn't have to be ignorant of the approval process He would be suing claiming that restraint on trade violates anti trust law. Big difference.
If the city topped Balmer, Sac might have a claim. It looks like Balmer and the Maloofs conspired, not the league as you said.
Because they put in the conditions allegedly about the BoG or the league blocking the sale not affecting the payment of the deposit, I don't think Hansen can turn around and sue if something he knew was a possibility actually happens. Buyer beware and all that...

You consider foolishly giving away $30M smart? I sure don't.
If that is indeed the reasoning behind the madness, it's actually rather stupid. Hansen/Ballmer offered the Maloof family that $$ of their own free will while full well knowing that the league has an approval process and that no sale is guaranteed (e.g. The NBA blocked the sale and relocation of the Timberwolves in '94).
The 30M offered up is no different than the $$ Va. Beach spent, of their own free will, in an attempt to lure the team. It didn't work out and they are now out that money. The Seattle group has a binding deal with the Maloof family, not the NBA. The Maloof family can't change their mind, but the NBA is under no obligation to approve the sale. This is a meaningless and toothless tactic. If it wasn't then the City of Sacramento could counter sue the Seattle group as they stand to lose far more than 30M if the franchise is sold and relocated.

Buyer beware isn't going to protect against the Sherman Act. He can't get the sale approved without that term. So that not only doesn't bar his suit. It would be the point of the suit.
Your counter is the equivalent of saying that Standard Oil could have won if they had included a clause in every sale that said, Standard Oil fixed these prices. I'm not saying the Bog approval is like price fixing- often goes the other way, but that's not at issue because its not a condition of Balmer's potential case.
This isn't going to swing things one way or the other, and I don't know if Balmer would sue or just wait his turn. But Balmer's deposit also serves as a very strong anti trust suit with at least 90 million in damages. That is a factor.
Im still pretty hopeful. But don't counter my fair assessment of the anti trust issue with, he knows or buyer beware.

This is what we've been trying to tell you.
No guarantee of winning, but not going down without a fight, either! KJ has been working on this for a while but the Maloofs had to come out and say the team is for sale first! Until that happened, there was nothing Sacramento could do. Now that an agreement has been signed, the wheels have been set in motion to try to keep the team here. The plans were being made but we had to reach that trigger point first.

these are great points. Balmer isn't the only guy with some sharp sticks in his bundle. Anaheim got a good look at the Sacramento way as well.
Carrots good market and sticks bad pr and litigation and doing everything to block construction in the other city. Both cities have them. I really think the Nba doesn't want to expand. I think the goal is to make such a strong Sacramento case, that it becomes the path of least resistance for the league

My favorite part of the interview was Joe Getty asked him straight up if the Maloofs were idiots. Marcos did not hesitate. Yes. The he said George Maloof is only a smart businessman according to Maloof family standards. He did give them some props. They're smart cause they found someone to overpay for what they have and he thinks the maloof will blow through their windfall in 18 months. No holds barred from Marcos this morning.

This whole situation reminds me of when Chris Webber was a free agent. Everyone was speculating. Sports writers who hate Sacramento said "Odds are Webber is leaving," but no one really knew. I'm going with the facts - the BOG will ultimately decide in April. Until then, I don't care what anyone in the media predicts.

Predictions, speculation, odds are all based on probability. They're just speaking to that probability. And the probability right now is exactly what you've been hearing. The odds of a 25 fadaway 3 pointer to win the game are always against you. Odds are you will lose. Does that mean you will always lose? No, but the ODDS are against you.
No one is saying it's done. They're all saying its basically and probably done. We are not the favored here. I'm not saying not to fight and not to find ways, but the odds ARE against us, and most prudent people in real life usually use favorable odds when making a prediction. Just because the outcome doesn't go according to the probability every time does not change the inherent odds beforehand.
