Weak or not, there's no excuse for drinking near the legal limit and driving. I have zero tolerance for it, have lost friends to it..08? Wow. That's weak
Regardless of how drunk you might feel after 8 beers in an hour, the body processes alcohol at virtually the same rates. Which is why BAT is allowed.
It's pretty much an hour on and hour off for .03. So two Budweisers in an hour will get you to .04 t0 .06, three will be around .06 - .09. There is some variation based on metabolism and body weigh, quickness of consumption etc.
So just because you do not feel drunk or buzzed, does not mean you are not well over the legal limit. 8 beers in an hour would put you around 1.6 to 2.0 legal limit +/-. This is me too BTW. I have an extremely high tolerance, but iI still won't drive if I have had more than 2 strong beers or 4 weak beers in a short time.
On the other hand, you could blow a .02 - .03 and still be arrested for drunk driving. As an example when my wife was young, a single beer would have her falling over drunk, yet she would still blow .03.
So in this case, Kayte could have blown a .08 but been visibly drunk which is why she was not let go with a borderline BAC.
Now she won't be on the sidelines, which is a good thing, I never liked her.

For a comparison in the media, Jalen Rose crashed his car, blew a .08 and did time in jail for a first time DUI offense. Still working for ESPN obviously.
I could go either way on this and would understand keeping Kayte on, or sending her packing. Whether she does jail time might enter into it. That depends on how lucky or unlucky you are when going before a judge.
