Gilbert Arenas Charged With Felony

I thought the fact that he was carrying it at business was the issue. :p
 
The author of the article assumes that the felony charge will be sufficient for the Wizards to immediately void Arenas' contract base don the citizenship clause. But I have a gut feeling that it would actually take a felony conviction, not just a charge, to invoke the clause...

Anyway, whatever happens to Arenas happens, but I'll be pretty upset if Crittenton gets off scot-free. If reports are true, his actions were far worse.

If Crittenton's gun was properly licensed, I don't know if there's a legal issue there.

I agree with you on the Wizards needing a conviction to void the contract, but I wonder if even that would get it done. The citizenship clause is pretty ambiguous, from what I've heard. They'd definitely get a fight. I think they'd have a better shot with the "gun at the arena" angle, which is indisputable. They'd still get a fight, but that seems like a better bet for them.

I'm not lawyer but I'm willing to assume that brandishing and loading your firearm is against the law.

They're going to need proof to convict Crittenton though, not just some article.

Well, according to the most detailed story I've seen, Arenas didn't draw or even hold the gun around Crittenton, he simply placed them, unloaded in Crittenton's space. Crittenton did draw and load and aim. Could be wrong, but that's the media version that seems most complete.

You're right about that. I guess the point is that he wouldn't be facing the same charges, provided his gun was legally registered. But how does brandishing a firearm get handled by DC law, if the firearm is registered? Is that illegal? If it's properly registered, he's allowed to have it at his place of business (according to DC law, not NBA rules). Does that allow him to draw it if he feels threatened? Hmm. I'm not trying to defend him, just wondering what his legal defense could be.

And there's no case against him at this point, because there's no evidence. Authorities searched his home and found no gun. The NBA doesn't need evidence, but that's a separate issue.

Yeah, that's what I gather from it as well. Seems kind of crazy that he could do five years, essentially for not having the proper paperwork. I wonder what this plea deal is going to look like.
