The real danger is civil litigation, especially in a case like the one with the bar fight. While there might not be enough evidence to convict Mike or, in this case, his cronies of any crime, there certainly might be enough (51%) to allow a jury to settle on a nice hefty monetary award if something like that were taken to court with a hungry lawyer. If, just for example because I don't know all the particulars from BOTH sides, it was found that it was Mike's actions that did, in fact, predicate the resulting brawl, etc. he could be found liable.
Is it far-fetched? Perhaps. Is it worth taking a chance on? Not in my book.
