If they don't give a qualifying offer they still retain the bird rights and can go or be over the cap to resign them.

The MLE is a slotted amount that counts towards the cap until it is renounced. Teams can't use money under the cap until the MLE is renouced.

Let McCant pass the ball go unless he hasn't signed with anyone after all the other deals are done.

33. What does renouncing a player mean?

As detailed in question number 30, free agents continue to be included in team salary. By renouncing a player, a team gives up its right to use the Larry Bird, Early Bird, or Non-Bird exceptions (see question number 19) to re-sign that player. A renounced player no longer counts toward team salary, so teams use renouncement to gain additional cap room. After renouncing a player, the team is still permitted to re-sign that player, but they must either have enough cap room to fit the salary, or sign the player using the Minimum Salary exception. The exception to this is an Early Bird free agent who is coming off the second season of his rookie scale contract. Such players, when renounced, are treated as Non-Bird free agents.
If the player does not sign with any team (his prior team or any other team) for the entire season, then his renouncement continues. In other words, the team is not permitted to renounce a player, let him lie idle for the year, then re-sign him the following summer using Bird rights. However, if the player re-signs with his prior team, then his renouncement is no longer in effect when his contract ends. For example, if a team renounces their Larry Bird rights to a player, then re-signs that player to a one-year contract using cap room, then the player is once again a Larry Bird free agent the following summer.
After renouncing a player, a team can still trade the player in a sign-and-trade agreement (see question number 76).

As I stated, you either have the MLE or the cap space. If you renounce the MLE then you have the cap space, which is more valuable. And as stated above. Until you renounce a player, he counts against your cap space. Once renounced, you lose all rights to him including Bird rights. You can't have it both ways.

Your mixing up 2 different things. Not giving an qualifying offer does not renounce the rights to the player. No qualifying offer means they become a free agent, but you retain their rights. Yes, here is still a cap charge until the player is renouced. But players dont have to be renouced right away, it only has to be done before you sign a free agent to gain the cap space.

We can also not give a qualifying offer, use the MLE then resign him. (not saying we should do this, but we can)

I think were both saying the same thing. My point was that you have to renounce a players rights in order to have the cap space. If you don't renounce the rights your hit with a cap hold. I think that there are people out there that think you can have the best of both worlds. I was just trying to clarify for some of them that if your over the cap, you have the MLE available. If your under the cap, you can either have the cap space or the MLE, but you can't have both. Obviously if the cap space is greater than the MLE, you would take the cap space, unless the player in question is someone you don't want to risk losing.

I agree with what you say about not making a qualifing offer and still retaining the Bird rights in order to give yourself time to decide. I just didn't think it was revelant in this case. Why would you hang on to the rights of a player like McCants, and then use the MLE to resign him when you could resign him with cap space and have more money left over. I don't see the logic in that. Cap space is more valuable than the MLE because it can use in conjunction with a trade. The MLE can't
