ATLANTA -- The Maryland judge who last month ruled Steve Belkin is entitled to buy the Atlanta Hawks and Atlanta Thrashers from his former co-owners added a new twist to the ongoing feud Thursday.

Montgomery County (Md.) Circuit Court Judge Eric Johnson ruled the current ownership and management team should retain control while the appeals are heard. But the good news for the Atlanta Spirit group also included the judge's stipulation that will prevent the Hawks or Thrashers from signing a free agent to a contract longer than one year.

The stipulation doesn't relate to negotiations with draft picks for either team.

The ruling also doesn't affect any negotiations already under way, including the Hawks' agreement to sign free agent point guard Speedy Claxton. The deal, believed to be for four years, cannot be officially announced before Wednesday.

Atlanta-based Michael Gearon Jr. of the Atlanta Spirit ownership group applauded the ruling.

"This is exactly what we always expected," Gearon told The Associated Press in a telephone interview. "It's hard for people who are looking at it from outside to understand all that has happened, but we expected to get a stay and are more confident than ever we will win on appeal."

The judge ordered that the other owners can't "initiate the purchase, sale, trade or negotiation of any NBA or NHL player contract ... excluding contracts involving present or future draft picks and contracts for any other player with a contract duration of one year or less."

The ruling would appear to put the Hawks and Thrashers at a significant competitive disadvantage in their ability to attract free agents.

Belkin, however, said he was "extremely confident in our ability to get the players we need."

The judge also ordered the owners to post an appeal bond of $11.4 million to protect Belkin against any decrease in the value of the franchises during the appeal. Belkin requested a much larger bond of up to $450 million.

Johnson ruled last month the ownership group did not abide by the terms of an agreement to buy out Belkin. The judge said the group's actions triggered Belkin's right to buy them out.

With Thursday's stay by the judge, his ruling last month is on hold until the appeal is heard by the Maryland Court of Special Appeals.

Ok, so not completely, but can only deal and sign players for one year... still really bad.


So, that means the Pacers or anyone can just go sign Al Harrington... who they are heavily interested in and have the advantage over the Warriors. Hawks getting nothing back for him, when they well could of. I feel quite bad for the Hawks... what a mess for now, and maybe awhile.

Indy is no doubt going to jump on this.

What the hell? Does the judge know anything about sports?

This is a death sentence for Atlanta if this extends to this day next year. Next year's FA pool is a good one I believe and Atlanta will miss out. Too bad.
 
This is going over so well here:rolleyes::mad: and as it affects both teams, people are ready to go to Maryland and kick some butt. I haven't heard player reactions yet but they did talk to j-smoove yesterday and he said all this was a big distraction and they just needed to resolve everything and make the team better. Poor Hawks just can't win even in court. I'm hoping they get these appeals heard and decided quickly.

that's irony for ya. the hawks can't win in the court or on the court.

Since only the Bobcats have cap room and they don't seem to be spending, and the Hawks can't sign and trade him, if this ruling stands this means Al Harrington will have to sign somewhere for the MLE. And at that point, who cares if he's not a perfect fit, let's go after him and figure it out later. That's a bargain.

Yes, but Speedy hasn't actually agreed yet -- or rather he has agreed to agree, but he won't sign the contract until the July 12. Wonder what the exact wording of that ruling is.

I'd do it... but he's wanted to go back to Indy, and if all else is equal, I'm sure that's where he'll go.

I'm not a big fan of Harrington for many reasons. I feel that he doesn't address any of our biggest needs. He's a tweener (6'9" 245lbs) with a good post game. In my book, he's a better version of SAR. Since Tyson Chandler isn't available anymore, I think the next most realistic option would be going after Samuel Dalembert. Philly could be looking at a major roster overhaul and he might be available for the right price.
 
I'd take Dalembert, I like him. At least is athletic, a great shotblocker, and damn good rebounder. Just not a post-defender, but we'd have guys for that. I remember when he outrebounded the whole suns team 23 or 22-21. ;)

On Harrington, don't think we really need him.

I feel bad for the hawks. Belkin's a greedy cheapskate and I hope Stern BANS HIM! We don't need losers like him in basketball.


BTW if I was Speedy I wouldn't want to sign there anymore. They can't make any other moves now and if Belkin gets his way and ends up owning the team then they'll never be a winning team.

Hawks are just not meant to win anymore. Well, for the least, atleast the tickets are cheap for when the Kings come here to play them. But, I was hoping they suceed, but with screwed up owners they have... not much you can do about it.
