Realistically they probably do both in most jurisdictions (They do in Sacramento).

By refusing the breathalizer and getting blood later his only hope is by the time he gets blood drawn he's under the legal limit.

Now, with Chuckie I doubt the 1/2 hour is enough to get that man under .08.
