Stern and the City win if very little changes after next week

The league has a very easy was of resolving this. They can simply maintain the status quo and take KJ off the clock. They can’t make the owners agree to a deal, but they can tell the Maloofs unequivocally, as long as the city is negotiating in good faith, you can’t move.

Stern doesn’t have to throw the Maloofs out of the league next week. He doesn’t have to risk asking his owners to back a city over one of their own. He just sits back with that wry smile and says, “Look, it took us 10 years but over a few months we’ve closed 90% of the ground.” The league is going to advance you the $ 3 million in predevelopment costs, and you won’t have to pay that or AEG’s share if the arena isn’t built. Now, go back to the table in Sacramento. But know that 2015 is not a make or break deadline for the league, and we’re not going to let you move the team for at least two years.”

This takes KJ off the clock. It allows the city to continue to get all of their ducks in a row on parking and other things, and frankly, they appear to need a little extra breathing room. While things could change in the interim, the city’s parking money, AEG’s desire to make money here, and the county’s parking garages seem firm. Even assuming there is a “break ground” deadline on any of federal funds that assist with the infrastructure surrounding the area, the city and Taylor should be more than capable of working and starting those projects “separately” in a way that dovetails and don’t damage the larger framework.

You know who doesn’t have time. The Kings. The 1997 loan is relatively the same size because it was almost exclusively interest payments for a long time. Well, that’s about to change. There is a reason they are making a mountain out of the 2015 open date. The team needs the city to refinance that loan at a better rate and over a longer term. They aren’t going to raise payroll until they set foot in a new building, and fans will continue to leave in droves as the team is run like the A’s.

Right now, the Maloofs have two threats on the table that give them some leverage. First, they can TRY to move the team. Second, they might be able to dump the arena and loan onto the city if they move. If Stern tells the team, “Look – we’re not picking a side here, but if you think you can tearfully announce a deal in Orlando, celebrate with the mayor at half court, and then turn around and declare an impasse and leave town, that’s just not going to happen. It’s not in the best interest in the league. I really want this resolved quickly, but that’s up the parties and out of my hands. In the meantime, as long as the city is negotiating in good faith and has a reasonable offer on the table, you can’t leave. If you are stuck at the table for two more seasons, that’s up to you. Unless there is a major change in the city’s conduct, we’re not even revisiting this issue for a year. And there is no way we’re ever letting you destroy the city’s’ budget by dumping Arco on them. In the meantime, I really hope you can close this deal. Good luck boys”

At which point, the playing field between the city and team are flat. The Maloofs can’t afford to keep playing at Arco or alienating their fans with the fact it’s now their fault the deal isn’t getting closed. And KJ can’t wait forever because the makeup of his counsel or other relevant factors could change. A deal would be done sometime in 2012, probably in six weeks.

The NBA gets to keep Sacramento, they might get to drop the Maloofs in a way that defensible in court. On the face of the deal, they just gave the city more time. The unspoken reality is the Maloofs can take the fair deal now or risk going broke and complexly destroy the resale value of thier franchise fighting over a few million dollars. Either way, the league wins. Either way, the team stays here.

Good read, It appears the Maloofs are inching closer and closer to their breaking point (selling). They will be okay just rebrand to "Maloof Skateboarding and Ent" lol.
 
I think the big point you've made here is that the opening-day 2015 deadline really is a league-imposed deadline and not a Maloof-imposed one. Had the Maloofs kept up their end of the bargain, they would have been committed to spending 3 more seasons at Nameless Rundown Arena before the opening of a Railyards facility. If they're going to throw a monkey wrench into the works, well, maybe that becomes 4 more seasons. But it's their own fault, and I think the league sees that.

The league told the City to get this done for the '15-'16 season. The city is ready to go, and by the next relocation deadline would certainly be either irrevocably committed to building the arena or clearly unable to go forward. But when the Maloofs take the timeline out of the City's hands, when the City is holding up their end of the bargain, that's on them. I think Stern's going to put it on them, too.

My guess is this. At the BOG meeting, the league is going to tell the Maloofs that until the City fails to come through, they will not get approval to move the team, and there will be a strong contingent of 20+ teams (more than the 15 needed to block a move by NBA bylaws) that will take that stand. Then the Maloofs will file an antitrust lawsuit. I truly believe it is going to happen, and it's going to happen quickly after the BOG meetings. I think the Maloofs are ramping up for it. The NBA will, as Larry David suggested, take the City off the clock as the whole antitrust thing goes down.

If the Maloofs lose, they give up and sell. If the Maloofs win -- that is, if the court rules that the 30 teams of the NBA must be independent and not subject to the oversight of the collective NBA -- they move the Kings to Anaheim only to find that no team in the NBA will schedule a game against them. The Phoenix Suns, as an independent company, decide not to schedule games against the Kings because their product is lousy and and they have a history of engaging in unethical business. And 28 other independent calls from 28 other independent teams just like them. Wouldn't that be fun?

Anyway, I think this is about to get ugly.
 
I wonder what are the terms of the league loan to the Kings. Would be interesting if they had a way to call in on it forcing them to sell.
 
I am wondering about the agreement between the NBA and the Maloofs. The NBA took over negotiations and the Maloofs had a lot of spare time as they didn't have to do anything. Now do the Maloofs have the legal right to pick and chose from what the NBA negotiated? Dumby me would think that if the Maloofs ceded the ngotiating to the NBA, they would be bound by what the NBA negotiated. Otherwise, why'd the NBA waste it's energy if all their hard work could be negated by the Maloofs.

Agreed. The NBA has been the team's representatives at the negotiations. I don't see the league backing out on the agreements to date.
 
The point where I would disagree is here you are, you have momentum, you have a friendly mayor, you have the outside investors you want/need. This is your moment. If you miss it, through Maloof manipulations or otherwise the CAVE people are given life and time to strike back. Maybe you even lose your friendly mayor or councilmembers. You lsoe Stern and the power he wields when he retires next year. It took you a dozen years to finally get the perfect storm together to get something done. You wait 2 years, or 3 years and you may find yourself in an environment with politcal leaders unable to get over the hump, with restrictions placed on even the parking scheme via the intiative process. When you've got Big Mo on your side, you have to run them out of the building. Back off, try to wait, and it gives all the forces that were working against you time to regroup.
 
True, but we've seen you're never going to get a deal with the Maloofs as long as they think they have a finger over the red "move now" button. They keep making unreasonable demands based upon take it or leave it. And the city can't meet those demands.

Delay is risky for the city, but I don't think KJ will be dumb with delay.

Taking KJ off the clock gives him the leverage. At some point, delay will bleed out the Maloofs. It's possible that KJ could wait out the Maloofs in just 12 or 18 months.

I don't think that will happen. I think KJ will say, we're rejecting your counter on these items, we'll meet you here on a few things, that's our offer. Why don't you get back to us when you are ready. H eneeds that power, and I think Stern will do that.

The deadline put the city into shape. The lack of one will get the Maloofs either in line or into total freakout.

KJ has the momentum to close this for at least 6 months. If Stern even give KJ another year, there is either a deal or an anti-trust lawsuit by the fall.
 
KJ going hard in the paint everyone hang on tight. Just let us know what you need from us Mr. Mayor were on board!
 
On Grant's show yesterday he kept telling a few callers and reiterating that the KINGS can't move and that they aren't going anywhere (the NBA won't allow it). He seemed pretty self assured with this statement. Hyperbole? Probably.
